This Premium Maintenance Plan Agreement is between Exterior Experts ("EE"), a Tennessee business located in Cookeville, TN, and the customer named at signup ("you"). At signup, EE collects: legal name, service-property address, billing address (if different), phone, email, and a payment method on file. The agreement is effective on the date you submit the signup form and pay the Annual Fee.
Your Plan covers four (4) scheduled visits per Plan Year, one per calendar quarter, with the services listed in your personalized schedule grid (the "Schedule") incorporated into this agreement at signup. The Schedule lists the specific services provided each quarter (e.g., house wash, gutter cleaning, window cleaning) and any "by-request" bonus services available during the Plan Year. Services not on the Schedule are not included; they are available à la carte at the member discount in clause 10. If your signup occurs mid-Plan-Year, your Schedule and Annual Fee will be pro-rated based on the number of scheduled quarters that fit within your first Plan Year; subsequent Plan Years cover all four scheduled quarters at the standard Annual Fee.
Your Annual Fee is calculated at signup based on your property's services and Schedule and is shown on the signup confirmation. The Annual Fee is due in full at signup and locks the per-service pricing for the Plan Year. Refund eligibility is set out in clause 4. The Plan Year is 12 months from the signup date.
(a) You may cancel at any time by contacting EE at the contact information on file. Cancellation stops future visits. (b) EE refund practice. EE works to make customers happy. If you cancel before any visits have been performed, EE will refund the full Annual Fee. If you cancel after one or more visits have been performed, EE will refund the prorated value of the unused remaining quarters (Annual Fee ÷ 4 × number of quarters not yet started). EE may, at its discretion, issue a more generous refund if circumstances warrant. (c) No-show / locked-out visits. If EE arrives on a scheduled date and cannot perform the visit because of a customer-side access failure (locked gate, no water, customer absent when presence is required), the visit counts as performed for proration unless EE waives at its discretion. (d) Refunds are issued to the original payment method within 14 days of cancellation.
This agreement covers one (1) Plan Year and does not auto-renew. Approximately 30 days before your Plan Year ends, EE will send you a renewal invitation showing next year's pricing and any Schedule changes. Your Plan continues into a new year only if you affirmatively accept the renewal and pay the new Annual Fee.
EE will perform each scheduled service in a workmanlike manner using industry-standard methods and solutions appropriate for the surface and conditions. Results may vary by surface age, prior treatment, and condition. You agree to work with EE in good faith to identify the cause of any concern and allow a reasonable opportunity for EE to re-perform or correct the affected portion of a service before treating the issue as a contract dispute. EE will respond to written quality concerns within five (5) business days of receipt and, where appropriate, schedule a corrective re-visit at no additional charge within the same Plan Year.
You are responsible for providing reasonable access to the service areas on each scheduled date, including: unlocked gates, working outdoor water spigots in the relevant area, removal of fragile items in the work zone, and (if pets are present) keeping animals away from the work area. EE will provide at least 48 hours' advance notice of each scheduled visit. If access cannot be provided, see clause 4(c).
Exterior cleaning is weather-dependent. EE reserves the right to reschedule a visit because of rain, freezing temperatures, lightning risk, sustained high winds, or similar conditions. Rescheduling is also available within a 14-day window at customer request, subject to EE's calendar. Visits delayed by weather or by EE for any reason outside EE's control (force majeure: severe weather, natural disaster, utility outage, public-health order, or comparable event) will be rescheduled to the next reasonable available date and remain part of the same Plan Year; if rescheduling into the current Plan Year is not feasible due to the cause of delay, EE will roll the visit into the first 30 days of the renewal term or, at your option, refund the prorated visit value.
EE may update its service methods, products, or visit-day-of operations as needed. Material changes to the Schedule (e.g., dropping a service from a quarter, materially reducing scope) will be communicated in writing at least 30 days in advance. If you object to a material reduction, you may cancel and receive a prorated refund per clause 4(b).
While this Plan is active, you receive 20% off à la carte services not included in your Schedule, billed separately at time of service. The member discount does not apply to materials charged at cost, third-party fees, or emergency / after-hours calls.
At signup, you authorize EE to retain your payment method on file for explicit future charges only. EE will not auto-charge the card on file for renewal, additional services, or anything else without your express prior authorization for the specific charge. The card on file exists to make explicit charges (e.g., à la carte services you request) faster — not to enable recurring billing.
If a dispute arises under this agreement, you and EE agree to first attempt informal resolution: written notice describing the issue, sent to EE, with a 30-day window to resolve. If the dispute is not resolved informally, either party may pursue mediation through a mutually agreed Tennessee mediator before filing suit. Any litigation arising from this agreement will be brought in the state or federal courts located in Putnam County, Tennessee.
EE carries general liability and workers' compensation insurance and will provide a certificate of insurance on request. EE's total liability arising out of or related to this agreement, regardless of theory, is limited to the Annual Fee paid for the current Plan Year. EE is not liable for: (a) damage caused by pre-existing conditions of the property (e.g., loose siding, failed seals, deteriorated wood) that EE could not reasonably detect before service; (b) consequential, incidental, or punitive damages; or (c) damage caused by your failure to provide reasonable access or accurate information about the property. Nothing in this clause limits EE's liability for gross negligence, recklessness, intentional wrongdoing, or any other liability that cannot lawfully be limited under Tennessee law.
This agreement is governed by the laws of the State of Tennessee without regard to conflict-of-laws rules. If any provision of this agreement is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be reformed to the minimum extent necessary to make it enforceable while preserving the parties' original intent. This agreement, together with the Schedule and signup confirmation, is the entire agreement between you and EE regarding the Plan and supersedes any prior oral or written understandings.

How is my Premium price calculated?
At signup we run our pricing engine against your specific home (sqft, stories, services). Year 1 may be prorated if you sign up partway through the calendar year; year 2 onward is the full annual fee.
When do you visit?
Each Plan Year includes up to 4 quarterly visits at the windows shown in the schedule above. We give 48 hours' notice before each visit.
What if it rains?
7-day rain guarantee — we re-do affected portions if it rains within 7 days of service.
Cancellation policy?
